A transsexual has launched a legal challenge after the NHS refused to pay for a breast enlargement operation, claiming the decision breaches her human rights.
The woman, named only as “C”, says that the refusal threatens to leave her in “limbo” and damages her emotional wellbeing.
But West Berkshire Primary Care Trust insists that the procedure would be “purely for cosmetic reasons”, with no compelling health grounds.
Lawyers for C, who has been living as a woman for 12 years, are challenging the decision through judicial review proceedings at the High Court, arguing that it amounts to sex discrimination and breaches her human rights.
She has received legal aid and the Equality and Human Rights Commission has been asked to provide expert submissions on the issues raised in the case.
Mr Justice Bean, sitting at the High Court in London, was told that while C has not yet had a sex change operation, she has been receiving hormone therapy since 1996 after being diagnosed as a transsexual.
But the treatment, designed to make her body more feminine ahead of a full sex change operation, had failed to make her grow “appropriate” breasts, the court heard.
Stephanie Harrison, representing C, said that it meant that her client would be left in a “state of physical limbo” if she underwent the surgery without also having a breast enlargement.
She argued that the case could not be compared with that of women who ask for breast enlargement operations simply because they are dissatisfied with their body.
It was part of the process fundamental to C becoming not only "psychologically and physically" a woman but also to her building her social life as a female, she said.
The court heard that C had been called names in the street by youths who did not "perceive her not to be a woman".
"She doesn't think that she is not a woman but is unhappy with the appearance she has," Miss Harrison told the court.
She went on: “The authority has failed to appreciate the significant difficulties when a transsexual seeks medical treatment which is for the purpose of resolving their disorder, in contrast with a person who seeks medical intervention for a cosmetic reason to do with their own dissatisfaction with their body image."

I wonder if this could become an issue here when ObamaCare goes into full swing. Given the Left's penchant for entitlement, they'll probably pay for everyone's boob jobs.
